Terms & Conditions

1. Agreement to Terms


These Terms and Conditions (“Terms”) form a legally binding agreement between you (whether personally or on behalf of a minor) and Ohio Fencing Center, an athletic training facility located at 6791 Dublin Center Drive, Dublin, OH 43017 (“OFC,” “we,” “us,” or “our”), governing your access to and use of the www.ohiofencingcenter.com website and all fencing classes, lessons, coaching services, events, and related offerings (collectively, the “Services”).
By accessing our website, registering for classes, or participating in any OFC program, you confirm that you have read, understood, and agreed to these Terms and all applicable laws. If you do not agree, you must discontinue use immediately.
For Parents and Guardians: If you are enrolling a minor (under 18 years old), you represent that you are their parent or legal guardian with the authority to accept these Terms and are responsible for all related obligations.
 
2. Who Can Use Our Services


Age and Legal Capacity:


To participate in OFC programs, you must:

  • Be at least 18 years old and have legal capacity under Ohio law, or
     

  • Be a minor whose parent or guardian has registered you, provided consent, and signed all required documentation.
     

USA Fencing Membership Requirement:


All participants must have a valid USA Fencing membership prior to participating in any OFC class, lesson, or event. Membership verification is the responsibility of each participant or guardian.


Parental Consent for Minors:


Under Ohio law, minors may not participate in athletic programs without parental consent. Parents/guardians must complete liability waivers, medical authorization forms, and concussion awareness acknowledgments (Ohio Department of Health Concussion Information Sheet) before participation begins.
 
3. Services Offered


OFC offers a variety of fencing services, including but not limited to:

  • Group classes for beginners through competitive levels (foil, épée, sabre)
     

  • Private lessons and lesson packages
     

  • Competition coaching and strip-side support
     

  • Collegiate and youth memberships
     

  • Open fencing sessions for members and guests
     

  • Special events (birthday, corporate, and educational programs)
     

All offerings are subject to coach discretion, scheduling, and compliance with these Terms.
 
4. Enrollment and Registration


Enrollment is first-come, first-served and space-limited.


Required Documentation:


Before participation, members must complete or submit:

  • USA Fencing membership verification
     

  • Signed waiver and release of liability
     

  • Medical and emergency contact forms
     

  • Parental consent (for minors)
     

  • Concussion information acknowledgment (as required by Ohio law)
     

Account Creation:


Some Services may require creating an account on the OFC website or scheduling platform. You are responsible for securing your credentials and any actions taken under your account.
 
5. Payment and Billing


Payment Terms:


All fees are due in advance of participation. Payments can be made online or via other approved methods.


OFC reserves the right to update pricing. Any changes will be communicated via email or website notice, and continued participation constitutes acceptance of such changes.


Late Payments:


Unpaid balances may result in suspension of participation until cleared.


Third-Party Processing:


Payments are handled by secure third-party processors (e.g., Wix, Square). OFC does not store complete credit card information.
 
6. Refunds and Cancellations


Under Ohio law, refund policies must be disclosed.


OFC’s Refund Policy:


All payments are non-refundable, except in cases of:

  • Documented medical emergencies, or
     

  • Program cancellations initiated by OFC
     

Not Eligible for Refunds:

  • Missed or unattended classes
     

  • Schedule changes by the participant
     

  • Dismissal due to conduct violations
     

Makeups:


Makeup classes may be offered at OFC’s discretion when notice is given at least 5 hours in advance.


Lesson Package Expiration:


Lesson packages must be used within 60 days of purchase unless otherwise noted.
Refund Processing:


Approved refunds are issued to the original payment method within 30 days.
 
7. Program Transfers and Upgrades


Members who wish to transfer between classes or upgrade plans must contact OFC administration. Such requests are subject to space and applicable fee adjustments.
 
8. Attendance and Makeups


Consistent attendance is encouraged for maximum improvement.
Makeups may be offered at OFC’s discretion based on coach availability and timely notification.
 
9. Safety, Conduct, and Facility Rules


Safety:


All participants must follow OFC’s safety protocols and USA Fencing rules. Respectful and sportsmanlike behavior is mandatory.


Right to Dismiss:


OFC reserves the right to dismiss participants for safety violations, misconduct, or failure to comply with staff instructions—without refund.


Assumption of Risk:


Fencing involves inherent physical risks. By participating, you (or your guardian) acknowledge and voluntarily assume all risks associated with fencing activities.
 
10. Equipment


Provided Equipment:


Beginner and trial fencers

may borrow club equipment. Advanced fencers must purchase and maintain their own gear.


Equipment Care:


Members are responsible for returning borrowed gear in good condition and for damages resulting from misuse.


Personal Equipment:


Privately owned gear must meet USA Fencing safety standards.
 
11. Liability Waiver and Release


Adult Participants:


By registering, you release and hold harmless OFC, its owners, coaches, and affiliates from any injury, damage, or loss arising from your participation, including those due to ordinary negligence.


Minors:


Parents/guardians acknowledge acceptance of all risks on behalf of their child and agree to indemnify OFC for claims related to participation.


Concussion Protocols:


OFC staff are trained in concussion recognition and will remove any participant exhibiting symptoms in accordance with Ohio law.


Medical Authorization:


You authorize OFC staff to seek emergency medical care if necessary.
 
12. Intellectual Property Rights


All text, graphics, imagery, and design elements on www.ohiofencingcenter.com are the exclusive property of OFC and protected by intellectual property law.


You may not copy, distribute, modify, or publicly use any content without written consent.


By submitting photos, testimonials, or other materials, you grant OFC a royalty-free right to use and display them for promotional purposes.
 
13. Photography and Video Release


By participating in OFC programs, you consent to being photographed or recorded for promotional or instructional use.


To opt out, you must notify OFC in writing before participation.
 
14. Holidays and Closures


OFC will communicate all scheduled holidays and closures in advance via email and/or website. Makeups for club-initiated cancellations will be offered where possible.
 
15. Communication and Updates
All official updates will be sent via email or posted on the member portal. Ensure your contact details remain current.


You may opt out of promotional communications at any time by clicking “Unsubscribe” or contacting OFC directly.
 
16. Right to Suspend or Cancel Membership


OFC may suspend or terminate memberships for rule violations or non-payment.


Members may cancel anytime by contacting OFC; however, refunds will only be issued per Section 6.
 
17. Indemnification


You agree to indemnify and hold harmless OFC, its owners, coaches, and staff against all claims or damages resulting from:

  • Your or your child’s participation in Services
     

  • Breach of these Terms
     

  • Violation of any law or rights of others
     

 
18. Limitation of Liability


To the fullest extent permitted by Ohio law, OFC and its affiliates are not liable for any indirect, incidental, or consequential damages arising from use of Services, including but not limited to:

  • Lost profits or data
     

  • Personal injury or property loss
     

  • Unauthorized access or alteration of personal information
     

 
19. Modifications to Terms


OFC may update these Terms at any time. The date at the top reflects the most recent revision. Continued use of Services constitutes acceptance of updates.
 
20. Governing Law and Dispute Resolution


These Terms are governed by Ohio law. Any legal proceeding must be filed in Franklin County, Ohio.


These Terms comply with the Ohio Consumer Sales Practices Act (ORC §1345.01 et seq.), and nothing herein limits your consumer rights.
 
21. Severability


If a court finds any provision invalid or unenforceable, the remainder shall remain in effect.
 
22. Entire Agreement


These Terms, combined with OFC’s Privacy Policy and signed waivers, represent the entire agreement between you and OFC.
 
23. Waiver


Failure by OFC to enforce any section of these Terms does not constitute a waiver of our right to enforce it later.
 
24. Electronic Communications and Signatures


By interacting with our website or completing forms, you consent to receive electronic communications and agree that digital signatures have the same legal effect as handwritten ones.
